These Terms of Service ("Terms") govern your use of the Babs website and application (the "Service"), operated by Babs ("Babs", "we", "us", or "our"). By using the Service, you agree to these Terms.

Description of the Service

Babs lets you connect social media accounts and compose, schedule, and publish posts across the platforms you connect, using brand and personality profiles you define.

Eligibility

You must be at least 13 years old to use the Service. If you connect a social media account on behalf of a business or another person, you confirm that you have the authority to do so.

Your account

You're responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately attech@mysms.promo if you suspect unauthorized use.

Acceptable use

You agree not to use the Service to:

• Post unlawful, infringing, or fraudulent content;
• Send spam or unsolicited bulk content;
• Connect or attempt to access an account you're not authorized to manage;
• Violate the terms of service of any connected platform; or
• Attempt to reverse engineer, disrupt, or gain unauthorized access to the Service.

Third-party platforms

Publishing to X, Facebook, Instagram, Reddit, LinkedIn, and Threads is subject to each platform's own terms of service and policies. Babs is not responsible for actions taken by those platforms, including suspensions, removals, or policy changes, even where they affect content published through the Service.

Your content

You retain ownership of the content you create and post through the Service. You grant Babs a limited license to store, process, and transmit that content solely for the purpose of operating the Service, including publishing it to the platforms you select.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could harm us, other users, or connected platforms.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of liability

To the maximum extent permitted by law, Babs will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Indemnification

You agree to indemnify and hold Babs harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes will be resolved in the state or federal courts located in New York.
